Previously, the United States District Court for the Central District of California had found that Maxchief and its distributors were infringing various Lifetime patents by importing and selling within the United States various Maxchief table products designated with “PT” model numbers. Initially, Maxchief tried to evade liability by arguing that its distributors were solely responsible for the infringing sales of its products within the United States. But once the court ruled that Maxchief shared its distributors’ liability for the infringing acts, Maxchief introduced a new product line designated with “BT” model numbers. On March 30, 2004, the court held that Maxchief’s new “BT” products, like Maxchief’s former “PT” products, infringe Lifetime’s patents.

CLEARFIELD, UTAH (October 27, 2003) -- Lifetime Products, Inc., a worldwide leader in the folding table market, announced today that the United States District Court for the District of Utah stated its intention to once again file a preliminary injunction against GSC Technology Corporation, a Canadian company charged with copying Lifetime’s recently introduced Personal Table™ product line.
Lifetime introduced its Personal Table™ product line last fall. The Personal Table™ is a durable, versatile and portable personal space solution with adjustable height settings, designed for indoor and outdoor use.
GSC sought to present an additional product design to compete with the Lifetime Personal Table. Upon learning of the additional GSC offering, Lifetime once again sought to enjoin any further manufacture, use, sales and offers to sell the GSC copies of Lifetime's Personal Table products. In the Hearing conducted on Lifetime's Motion for Preliminary injunction on October 22, 2003, the Court stated its intention to enter a written order providing for the following injunctive relief: that Lifetime is likely to prevail at trial on its patent claims and that the Court will preliminarily enjoin GSC from importing, offering to sell or selling its newly offered infringing product into or within the United States.The court stated it also intends to order GSC to offer to purchase the infringing tables in its customers' inventory at the price at which they were sold, plus shipping and handling.
Additionally, the court stated it intends to order GSC to inform its customers of the issuance of the injunction and of the fact that if the Court does not change its preliminary finding of infringement at trial, the customers will be direct infringers if they sell the infringing tables. Significantly, the Court determined that GSC is to be enjoined from further sales and offers to sell its Personal Table, effective immediately. The Court's orally stated injunction order is to be followed in the near term by a written opinion.

CLEARFIELD, UTAH (February 21, 2003) – Lifetime Products Inc., a worldwide leader in the folding table market, announced today that it was granted a summary judgment of literal infringement against Alton Industries, Inc., a competitor in the folding table market.
“This decision by the Court represents a major success in the enforcement of patents that protect Lifetime’s blow-molded, polyethylene folding utility tables,” said Larry R. Laycock, lead litigation counsel for Lifetime.
Lifetime recently filed claims in the United States District Court for the Central District of California against Alton Industries, Inc. and its supplier Maxchief Investments, Limited for infringement of Lifetime’s recently issued United States Patent No. 6,431,092. On February 19, 2003, the Court entered an Order granting summary judgment in favor of Lifetime finding that the Maxchief accused blow-molded tables distributed by Alton infringe multiple claims of Lifetime’s patent.
In making its ruling, the court determined as a matter of law that when the claims asserted by Lifetime are properly interpreted, no reasonable jury could be persuaded by the defendants’ arguments that their products do not infringe. Lifetime intends to continue its vigorous pursuit of all available remedies against Alton, Maxchief, and all other unauthorized infringers of Lifetime’s valuable intellectual property assets. On Tuesday, that court entered an order denying NorthPole’s motion for summary judgment of noninfringement of Lifetime’s United States Patent No. 5,536,552. In denying NorthPole’s motion, the court ruled that Lifetime has presented evidence that could justify a jury verdict in its favor. The court’s ruling preserves Lifetime’s opportunity to present its case to a jury.

In its ruling, the court refrained from interpreting patent claims and indicated that it would be willing to reconsider Lifetime’s request for extraordinary relief after the conclusion of the claim interpretation process prescribed by local court rules. Lifetime will seek to accelerate the pace of claim interpretation proceedings in order to hasten the injunctive relief sought against NorthPole.

The Order also provides that Wen’s Phoenix is enjoined from actively inducing others to infringe and from engaging in any acts of contributory infringement of Claim 1 of the ‘552 patent. Finally, Wen’s Phoenix has been enjoined from all other acts of infringement of Claim 1 of the Lifetime ‘552 patent.
